Abstract

Before the entry in force of the law 64-00, the commanding situation in the Dominican Republic in the environmental frame was deficient, many juridical procedure existed with environmental content, environmental right did not exist as such, the organisms (organisations) and institutions of the environmental sector were dispersed, an effective planning did not exist, there was need to create an environmental effective right. With posteriority to the promulgation of the law 64-00 and as consequence of this event, there was created the National Service of Environmental Protection or Environmental Policeman(Police), by means of the decree Not. 1194 of November 13, 2000. The Secretariat of State of Environment and Natural Resources remained constructed attending to his (her,your) areas of competition and functions, being organized in five subsecretaries of State: 1) the Subsecretary of environmental Management; 2) the Subsecretary of Soils and waters; 3) the Subsecretary of forest Resources; 4) the Subsecretary of protected Areas and biodiversity; and 5) the Subsecretary of coastal and marine Resources. To all that the promulgation of the law joins 307-04 of the year 2004 that comes to repeal in its entirety to the law 5914 of the year 1962. This new law creates the Dominican Advice (Council) of the Fishing and Acuicultura (CODOPESCA). Recently the executive director was designated by the responsibility the sector reordered nacional fishing.
